Our partner Leonard Yeoh along with associate Pua Jun Wen won a criminal appeal at the High Court under the Employees’ Social Security Act of 1969, namely Section 5 and 94(g).
In this landmark case, a global company was accused of violating Section 5 of the Employees’ Social Security Act of 1969 by neglecting to register and pay SOCSO payments for an employee.
A very significant victory in Court for our client and congratulations to Leonard Yeoh and Pua Jun Wen!

Our dispute resolution team led by partner Soo Chuan Cheah with the able assistance of wei wen khor, Chen Mei Yan and Jia-Yi Hoong has successfully arrested and grounded a Boeing 777 aircraft at Kuala Lumpur International Airport (KLIA) two days ago. This latest success unmistakably demonstrates our strengths and core competency to manage contentious aviation disputes.
News of this high-profile case eventually broke out across the global media one day after the aircraft arrest that a passenger aircraft operated by an international airline was seized at KLIA. Although there is a famous saying of how lightning doesn’t strike the same place twice, this is the second time that the same Boeing 777 aircraft has been seized in Malaysia. Tay & Partners was involved in the last successful aircraft arrest two and a half years, and now did it again!

CAN YOU BE REINSTATED AFTER RESIGNING AND ACCEPTING SEVERANCE PAYMENT?

It is trite law that an employee may accept a severance package and yet file a wrongful dismissal claim subsequently. The law goes as far as to state that an employee or workman may even sign a clause stating that he has no further claim and yet he may still file such a claim. It is well settled that estoppel has no place in industrial jurisprudence.
In the recent reported Industrial Court case of Ng Wei Jye v Kaspersky Lab SEA Sdn Bhd (case no.: 7/4-1568/18), the employee had agreed to the Separation and Release Agreement (“SRA”) and accepted the severance payment. The employee then filed a for wrongful dismissal claim at the Industrial Court and wanted to be reinstated to her original position.
The Court found that the conduct of the Claimant in agreeing to the SRA and by negotiating for a separation package, has indeed negated the elements of purported coercion and duress by the Company. The Court further observed that there was an element of willingness on the part of the Claimant when she negotiated for a separation sum which was more favourable to her.
The Court, having considered the circumstances, found that the Claimant’s employment had ceased by mutual agreement and that the Claimant had voluntarily negotiated and accepted the SRA. There was no dismissal of the Claimant within the context of Section 20 of the Industrial Relations Act 1967.

Tay & Partners Advised Transaction Awarded as Asia Business Law Journal’s Deal of the Year for 2017

Tay & Partners acted as Malaysian counsel to Crédit Agricole Corporate & Investment Bank (“CACIB”) in its financing of a portfolio of fourteen CFM56-5B spare engines (the “Engines”) to Asia Aviation Capital Limited. The transaction has been awarded as the Deal of the Year 2017 by the Asia Business Law Journal.
The deal was valued at US$65 million and involved multiple jurisdictions including Thailand, Indonesia, Philippines, India and Japan.
The lenders involved in the transaction include The Korea Development Bank and NTT Finance. CACIB also acted as mandated lead arranger, security trustee and facility agent in the transaction. The Korea Development Bank acted as the arranger.
The Tay & Partners team was led by Yip Jia Hui and assisted by Mendy Tan.

Former Malaysia Tourism Promotion chairman and Ex-Member of Parliament loses his appeal against AirAsia Berhad to obtain discovery of certain documents in a widely reported defamation suit brought by the leading low-cost airline.
Lead Counsel Leonard Yeoh, appearing for the airline, argued successfully that when relying on the defence of justification, the appellant cannot seek discovery of documents from the respondent (AirAsia Berhad) to justify his statements, especially when the orders sought amounted to a fishing expedition.
Leonard Yeoh represented AirAsia Berhad, assisted by Yeoh Jit Wei and Yeo Yen Hock.

Tay & Partners represented AirAsia Berhad in a competition law appeal against a decision alleging market sharing between the budget airline and Malaysia Airlines System Berhad. Tay Beng Chai heads the team of Leonard Yeoh, Wong Weng Yew, Nicole Leong and Lynette Yee who secured a landmark victory decision before the Competition Appeal Tribunal which ruled that the Malaysia Competition Commission’s market sharing infringement decision and the financial penalty of MYR10 million must be set aside. This unanimous decision by the five-member tribunal marks the first decision delivered by the Competition Appeal Tribunal after the Competition Act 2010 came into force 4 years ago in Malaysia.
