Insider TAPS Issue 004 - Singapore Arbitration award not enforceable in Malaysia

The Malaysian Court of Appeal recently decided that an Arbitration award in Singapore could not be directly enforced in Malaysia.

This was because there had been no notification in the Government’s Gazette declaring Singapore as a party to the New York Convention.

This decision involved the Board of Control for Cricket in Sri Lanka which was being sued by World Sport Nimbus Pte Ltd.

The Court however gave guidance for parties in finding that the proper way to proceed is for the Award to be registered as a Judgment in the Singapore High Court which could then be enforced in Malaysia under the arrangement between Malaysia and Singapore as to the reciprocal enforcement of judgments.
