Talk on Trademarks Act 2019

Following the recently passed Trademarks Act 2019 that is anticipated to come into force in the fourth quarter of the year, Tay & Partners was invited to speak and train members of staff and senior management of client, a leading infrastructure and development group of companies at the Black Box on 5th September 2019. The training concluded with a lively question and answer session. Our IP partner, Lim Bee Yi and senior associate, Shawn Voon conducted the training.

Tay & Partners, in co-operation with Bird & Bird organised a seminar on Trade & Investments with China: Post Investment Laws held at EQ, Kuala Lumpur on 29 April 2019.
At the seminar, we discussed the much anticipated new foreign investment trade law developments in China which was presented by Mr. John Shi, Partner of Bird & Bird and a comparative study on the employment law and practice in Malaysia & China which was presented by our Employment & Industrial Relations partner, Mr. Leonard Yeoh and Ms. Ying Wang, Partner of Bird & Bird.
Corporate Liabilities under Anti-Corruption Laws and Anti-Money Laundering in Malaysia Seminar (14 March 2019)
Tay & Partners’ seminar on Corporate Liabilities under Anti-Corruption Laws and Anti-Money Laundering in Malaysia held at the Sime Darby Convention Centre on 14 March 2019.
The seminar provided an overview of the Malaysian Anti-Corruption Commission (Amendment) Act 2018 which was presented by Ms. Nicole Leong and the general overview of Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001, as well as preventive measures to anti-money laundering allegations which was presented by Mr. Leonard Yeoh. We have also invited guest speaker, Mr. Zakaria Mohamad of SIRIM QAS International to speak on the ISO 37001: Anti-Bribery Management System Certification.

Tay & Partners Advised Transaction Awarded as Asia Business Law Journal’s Deal of the Year for 2017

Tay & Partners acted as Malaysian counsel to Crédit Agricole Corporate & Investment Bank (“CACIB”) in its financing of a portfolio of fourteen CFM56-5B spare engines (the “Engines”) to Asia Aviation Capital Limited. The transaction has been awarded as the Deal of the Year 2017 by the Asia Business Law Journal.
The deal was valued at US$65 million and involved multiple jurisdictions including Thailand, Indonesia, Philippines, India and Japan.
The lenders involved in the transaction include The Korea Development Bank and NTT Finance. CACIB also acted as mandated lead arranger, security trustee and facility agent in the transaction. The Korea Development Bank acted as the arranger.
The Tay & Partners team was led by Yip Jia Hui and assisted by Mendy Tan.

Congratulations to our Dispute Resolution Practice Group who won at the Court of Appeal

Former Malaysia Tourism Promotion chairman and Ex-Member of Parliament loses his appeal against AirAsia Berhad to obtain discovery of certain documents in a widely reported defamation suit brought by the leading low-cost airline.
Lead Counsel Leonard Yeoh, appearing for the airline, argued successfully that when relying on the defence of justification, the appellant cannot seek discovery of documents from the respondent (AirAsia Berhad) to justify his statements, especially when the orders sought amounted to a fishing expedition.
Leonard Yeoh represented AirAsia Berhad, assisted by Yeoh Jit Wei and Yeo Yen Hock.

Tay & Partners represented AirAsia Berhad in a competition law appeal against a decision alleging market sharing between the budget airline and Malaysia Airlines System Berhad. Tay Beng Chai heads the team of Leonard Yeoh, Wong Weng Yew, Nicole Leong and Lynette Yee who secured a landmark victory decision before the Competition Appeal Tribunal which ruled that the Malaysia Competition Commission’s market sharing infringement decision and the financial penalty of MYR10 million must be set aside. This unanimous decision by the five-member tribunal marks the first decision delivered by the Competition Appeal Tribunal after the Competition Act 2010 came into force 4 years ago in Malaysia.

Tay & Partners together with Bird & Bird had presented a half day seminar on Data Protection Summit on 12 February 2015 at Parkroyal Hotel Kuala Lumpur with 53 participants. The seminar provided an overview of the EU data protection regime which was presented by Mr. Gabriel Voisin from Bird & Bird UK and the recent developments in Asia Pacific data protection laws which was presented by Mr. Dharma Sadasivan from ATMD Bird & Bird Singapore. Our partners Ms. Lee Lin Li and Mr. Chang Hong Yun spoke on the Malaysian legislation with particular focus on the transfer of personal data overseas. The seminar also highlighted the challenges that Malaysian companies face when bringing foreign franchise concepts into Malaysia.
